Family of Tony Borcia to Sue Fox Waterway Agency

The agency has been added to a wrongful death lawsuit filed by the family against David Hatyina of Bartlett and his girlfriend Renee Melbourne, according to the Daily Herald.

The family of Tony Borcia, a 10-year-old Libertyville boy killed last summer while tubing on Petite Lake, is suing the Fox Waterway Agency and seeking more than $250,000 for claims the agency did not enforce boat safety rules, according to the Daily Herald. 


The Butterfield School fifth-grader was enjoying a day on the lake with family and friends on July 28, 2012, when he fell off of an inner tube and was struck by David Hatyina's boat and was killed. 

Hatyina, 51, of Bartlett was sentenced to ten years in prison in June for a charge of aggravated DUI, according to the Chicago Tribune. 

The lawsuit alleges the Fox Waterway Agency should have set up speed limits, established areas for safe tubing and water-skiing on the Chain O' Lakes and restricted the size of boats allowed, according to the Daily Herald.
