Reduced Sentence Denied for Intoxicated Boater Who Struck and Killed Libertyville Boy

Tony Borcia, 10, of Libertyville, was killed last July when he fell off of an inner tube and was struck by boater David Hatyina, who was under the influence of cocaine and alcohol.

The 10-year prison sentence for David Hatyina, the Bartlett man who struck and killed Tony Borcia, 10, of Libertyville, while operating his boat on the Chain O' Lakes last summer while intoxicated, will not be reduced, reported the Daily Herald.

The request for a shorter sentence was heard over a two-day court hearing attended by both sides' families, according to the story.

Borcia was killed July 28, 2012 while tubing on Petite Lake when he was struck by a 29 foot boat driven by Hatyina, who later admitted to drinking alcohol earlier that afternoon. A blood test taken the same evening of the incident revealed the presence of cocaine and alcohol in his system. In addition, cocaine residue was found on his boat near the operator’s console, according to the Lake County State's Attorney's Office.
