Sentencing for Boater Who Ran Over Child to Include Impact Statements

A request to limit the number of victim impact statements at the sentencing for a Bartlett man who has plead guilty to being under the influence of drugs and alcohol when he struck and killed a Libertyville boy with his boat last summer was denied by the judge at a court hearing Thursday, reported the Lake County News-Sun.

Instead of going to trial, David Hatyina, 51, struck a plea deal and plead guilty to one count of aggravated driving under the influence of drugs and alcohol, reported Patch.

Next month's sentencing for Hatyina will include five impact statements from the immediate family of Anthony "Tony" Borcia, a Butterfield School fifth-grader who died July 28 while enjoying a day on Petite Lake with his family, according to the News-Sun.

The Borcia family has also filed a wrongful death lawsuit against Hatyina, reported Patch.
