Village Settles Lawsuit with Concept Team

The settlement agreement will allow a proposed condominium to be built on Milwaukee Avenue.

The Village of Libertyville has settled a lawsuit that will allow a proposed condominium to be built on Milwaukee Avenue.

In early 2008, the Concept Team Inc. filed a lawsuit against the village after the village board denied site plans for a proposed eight-unit residential building at 1441 N. Milwaukee Ave.

The village board approved the settlement agreement during the March 22 board meeting. Mayor Terry Weppler recused himself and appointed Trustee Donna Johnson as Mayor Pro Tem because he had previously represented the Concept Team.

“The site plan was denied by the village board, based in part because of its proximity of the proposed building to an existing billboard located on the property at 1441 N. Milwaukee Ave.,” Johnson said during the meeting.

The lease that allows the billboard to remain on the property will expire on Sept. 27, 2013.

As part of the settlement agreement, the Concept Team is required to notify the owner of the billboard that the lease will be terminated when the lease expires. It also imposes the requirement upon any subsequent owners in the event that the Concept Team no longer owns the property.

The village’s insurance carrier has agreed to pay $7,500 to the Concept Team to settle the lawsuit. The village has also agreed to waive park impact fees, water connection fees and sewer connections fees in the combined amount of $17,500.
